Serious offenses will require full consensus from jury members.
On Monday the Supreme Court issued their opinion in the case of Ramos v. Louisiana. Although the Court is not meeting in person due to COVID-19 social distancing guidelines, the Justices of the Court have been meeting via video conference to discuss their thoughts about cases previously heard.
The ruling in Ramos v. Louisana found that Louisiana’s non-unanimous jury provision was unconstitutional and that Evangelisto Ramos could not be charged with murder without a fully unanimous jury. According to Justice Gorsuch, “One of these requirements was unanimity. A jury must reach a unanimous verdict in order to convict. The answer is unmistakable.”
